1. Definitions

• "Services" means the AI video generation platform operated by KuaiKuaiChuHai, including all related websites, software, and APIs.
• "User Content" means any text, images, audio, videos, or other materials you upload, submit, or input into the Services.
• "Output" means the video content generated by the AI based on your User Content.

2. Acceptance of Terms

By accessing the KuaiKuaiChuHai platform and using our Services, you confirm that you have read, understood, and agreed to be legally bound by these Terms of Service and all applicable laws of the People's Republic of China. You represent that you are at least 18 years of age and have the full legal capacity to enter into this agreement.

3. Account Registration

To use KuaiKuaiChuHai, you must create a unique account. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and current information during registration.

4. AI Model Training Policy

KuaiKuaiChuHai Commitment: Unlike many industry participants, KuaiKuaiChuHai explicitly agrees NOT to use your uploaded materials (including but not limited to text prompts, images, video clips, and audio) or the resulting generated output to train, fine-tune, or otherwise improve our AI models or foundational algorithms. Your creative data remains strictly your own and is processed only to fulfill your specific service requests.

5. Fees and Refunds

• Pricing: KuaiKuaiChuHai offers various subscription tiers and credit packages. Prices are displayed on our website and are subject to change upon notice.
• Refund Policy: All payments made to KuaiKuaiChuHai are non-refundable. Due to the immediate consumption of computational resources required for AI generation, we do not offer refunds or credits for partially used billing cycles or unconsumed credits, unless explicitly required by the mandatory laws of Mainland China.

6. Intellectual Property and Content

• 6.1 User Content: You retain ownership of the original content you input into the Services. You represent and warrant that you hold all necessary rights and licenses for any materials you upload, and that such materials do not infringe upon the intellectual property, privacy, or other rights of any third party.
• 6.2 Output: Upon full payment and subject to your compliance with these Terms, KuaiKuaiChuHai grants you all ownership and commercial usage rights for the generated Output. You acknowledge that due to the nature of AI technology, Outputs generated for different users may be similar, and KuaiKuaiChuHai does not guarantee the uniqueness or exclusivity of any Output.
• 6.3 Feedback: If you provide any suggestions, ideas, or feedback regarding the Services, you grant KuaiKuaiChuHai a perpetual, irrevocable, royalty-free right to use them for any purpose without any obligation or compensation to you.
• 6.4 Platform Rights: KuaiKuaiChuHai retains all rights, title, and interest in the platform's software, design, logos, and underlying technology.

7. Prohibited Conduct

You agree not to use KuaiKuaiChuHai to:

• Generate content that is illegal, violent, pornographic, or promotes hate speech.
• Infringe upon the intellectual property or privacy rights of any third party.
• Attempt to reverse engineer, decompile, or extract the source code of our AI models.
• Engage in any activity that interferes with the integrity or performance of the Services.

8. Immediate Data Deletion

KuaiKuaiChuHai respects your "Right to be Forgotten." You may request the deletion of your account or specific data at any time. Upon receiving a valid deletion request, KuaiKuaiChuHai will respond immediately and purge the designated data from our production servers without any retention buffer.

9. Limitation of Liability and Indemnification (TopView Inspired)

• 9.1 Disclaimer of Warranties: The Services and all materials are provided on an "as is" and "as available" basis. KuaiKuaiChuHai disclaims all representations and warranties, express or implied, including but not limited to the accuracy, reliability, or completeness of the Output or any information on the website.
• 9.2 Exclusion of Liability: To the fullest extent permitted by law, KuaiKuaiChuHai shall not be liable for any damages arising from your use of the Services. This includes, without limitation, direct loss, loss of business or profits, damage to your computer, software, systems, and data, or any other incidental or consequential damages.
• 9.3 Liability Cap: In the event that KuaiKuaiChuHai is found liable despite the above exclusions, our total aggregate liability for any claim shall not exceed the amount paid by you to KuaiKuaiChuHai in the six (6) months preceding the event, or fifty dollars (U.S. $50), whichever is higher.
• 9.4 Indemnification: You agree to indemnify and hold KuaiKuaiChuHai, its employees, agents, and affiliates harmless from any and all losses, damages, liabilities, costs (including reasonable attorneys' fees), and third-party claims arising out of your breach of these Terms or your misuse of the Services. You shall provide us with such assistance, without charge, as we may request in connection with any such defense.
• 9.5 Force Majeure: KuaiKuaiChuHai shall not be liable for any failure to perform obligations due to events beyond our reasonable control, including but not limited to Acts of God, war, terrorism, natural disasters, or infrastructure failures.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China (Mainland China). Any disputes arising out of or in connection with these Terms shall be submitted to the jurisdiction of the People's Court in the district where KuaiKuaiChuHai is registered.

11. General Provisions

• 11.1 Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• 11.2 Entire Agreement: These Terms constitute the entire agreement between you and KuaiKuaiChuHai regarding the use of the Services and supersede any prior agreements or representations.
